General

These Terms of Service apply to each website listed under Websites Covered below (each, and together, the "Site"), all owned and operated by Management Coaching of Wyoming, LLC ("Company"). Throughout these Terms of Service, "I," "me," and "my" refer to Anthony S. Jackson, acting for the Company. By using the Site, you agree to be bound by these Terms of Service, my Privacy Policy, and any additional terms that apply to a specific product or service. Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms of Service.

I may change these Terms of Service from time to time by posting the revised version on this page with a new "Last updated" date. By continuing to use the Site after I post a change, you accept the Terms of Service as modified. A change never alters the terms of a purchase you have already made; that purchase stays governed by the terms in effect when you made it.

Intellectual Property Rights

My Limited License to You. The Site, all the materials available on it, and every product sold through it are my property and/or the property of my licensors, and are protected by copyright, trademark, and other intellectual property laws. You may use the Site for your own personal use. Unless these Terms of Service allow it or I authorize it in writing, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works from, exploit, or distribute any material from the Site, in any manner or medium, including by email or other electronic means. You may download or print one copy of individual pages of the Site for your personal use, provided that you keep intact all copyright and other proprietary notices.

Internal Use of Purchased Materials. If you buy a product meant to be used by a team, such as TeamOS™, you may reproduce and use its materials, including the binder templates, for internal use within your own organization. You may not resell them or distribute them outside your organization.

Your License to Me. When you post material publicly, where anyone can see it, such as a comment on one of my articles or a public social media post that mentions me, you represent that you own the material or have the owner's consent to post it. You grant me a royalty-free, perpetual, non-exclusive, worldwide license to use, reproduce, display, and distribute that public post, and to identify you as its author by name or screen name. This license covers public posts only. What you send me privately, including applications, survey answers, emails, posts in a private community, what is said in a cohort session, and material you share for a Structural Bearing™ Diagnostic, is not covered by this license; it is handled as described under Surveys and What You Tell Me.

Limitations on Linking and Framing. You may link to the Site so long as the link does not state or imply any sponsorship of your site by me or by the Site. You may not, without my prior written permission, frame or inline link any of the content of the Site, or incorporate into another website or other service any of my material, content, or intellectual property.

Disclaimers

Throughout the Site, I may provide links to websites maintained by third parties. Linking to them does not imply that I endorse or sponsor those websites or the information, products, or services offered on or through them. I do not operate or control any information, products, or services that third parties provide on or through those websites.

Any opinions, advice, statements, services, offers, or other content expressed or made available by third parties are those of their respective authors or distributors, and not of the Company.

EXCEPT FOR THE GUARANTEES STATED UNDER PRODUCTS & SERVICES, THE INFORMATION, PRODUCTS, AND SERVICES OFFERED ON OR THROUGH THE SITE ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, I DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. I DO NOT WARRANT THAT THE SITE OR ANY OF ITS FUNCTIONS WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY PART OF THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

You agree to defend, indemnify, and hold harmless the Company, its affiliates, successors, assignees, and licensees, and their respective agents, officers, directors, owners, and employees, from and against any and all claims, causes of action, damages, liabilities, costs, and expenses, including legal fees, arising out of or related to your breach of any obligation, warranty, representation, or covenant in these Terms of Service.

Results. Case studies, examples, and observations on the Site and in my products are accounts of what happened on specific teams, including my own. They are not a promise that you, your team, or your organization will see the same result. Results depend on the organization, the people in it, and the effort put into the work. Nothing on the Site is legal, financial, or human-resources advice for your specific situation.

Products & Services

This section states the terms specific to each current offer. Where a term appears here, it controls over the general language elsewhere on this page for that product. Wherever a term below says to contact me, use the email address under Contact.

Books: Quiet Confidence, LeadershipOS™, The Edge Case, Structural CTO™, and future titles, each sold through its own site.

  • Guarantee: if a book does not deliver, for any reason, send it back within one year of receipt. I refund every penny: the book cost and the original shipping, both. No explanation required.
  • Returns: contact me and I send you a prepaid return label.
  • Pre-orders: you can cancel a pre-ordered book at any time before it ships, for a full refund.
  • Shipping: shipping details for your book, including timing, are sent to you by email after you order.

TeamOS™: The Operator ($897).

  • Guarantee: open the box, read the book, and work through the installation. If TeamOS™ is not right for your team, send the book and the binder back within 60 days of it arriving. I refund the full $897 and cover the return shipping. The guarantee asks only that the book and the binder come back; it does not ask you to prove anything about your results.
  • How to return: reply to any email from me, or contact me, and say you want to return it. I send you a prepaid return label.
  • Refund timing: I issue your refund within 5 business days of the returned package arriving back to me.
  • Cancelling before it ships: you can cancel at any time before your order ships by telling me. I refund the full $897, and there is nothing to send back. Once it has shipped, the return terms above apply: the book and the binder come back to me first.
  • Shipping: I ship these myself. No shipping timeframe is promised; if your order arrives later than expected, contact me and I will make it right.
  • Inner Circle: the four included months of LeadershipOS™ Inner Circle are governed by the Inner Circle terms below. A return or a cancellation ends the Inner Circle continuity along with it, including its access and its charge.

TeamOS™: The Cohort ($3,997) and The Guided Cohort ($9,997, or $16,997 with the in-person intensive).

  • Applying: an application is not an acceptance. I may accept an application, recommend a different tier, or decline it. If you are accepted, you receive an email with the cohort's start date and the date by which to enroll. No payment is taken at application; payment is taken at enrollment, close to the start date.
  • If something is not working, I fix it first. Raise it in a session or send it to me directly, and you will have a response within three business days.
  • Full refund at any time before your cohort begins, for any reason.
  • Full refund through the end of the third of eighteen weekly sessions. You do not have to explain yourself.
  • Returning the materials: a refund at either point above requires the TeamOS™ book and binder to come back to me. I send you a prepaid return label. If they are not returned, the refund is the amount paid less $897, the price of The Operator.
  • The Guided Cohort: you can take that refund without explaining yourself. You can also talk to me first about whether what you are running into is a fit problem or a timing problem. That conversation is an offer, never a condition of the refund.
  • After the third session, a refund is no longer available. What you have instead is a standing place in a future cohort, taken up whenever a seat opens. This is a standing place, not a guaranteed seat.
  • If I cancel a cohort before it begins, I contact each enrolled member personally, and the full refund above remains available to every one of them.
  • Withdrawing: a withdrawal with a refund ends the included Inner Circle continuity along with it, including its access and its charge.
  • Confidentiality: what is said in a session stays in the room, and nobody's employer is named outside it. This is a condition of membership in a cohort, and I will remove a member who breaks it.
  • The Guided Cohort's in-person intensive: optional, decided by the cohort together partway through the installation, and invoiced separately at $7,000 per member, with travel within the continental United States covered. Once booked, the intensive is not fully refundable. If you cancel before you travel, I refund whatever portion of the cost I am able to recover.
  • Inner Circle: the four included months of LeadershipOS™ Inner Circle are governed by the Inner Circle terms below.

LeadershipOS™ Inner Circle Newsletter (direct subscription, and the four months included with every TeamOS™ tier).

  • Standard pricing: $9.95 for the first month, then $97 per month, moving to $147 per month for new subscribers once the subscriber base reaches 50.
  • Rate lock: the rate you begin at is your rate for life, for as long as you remain subscribed. A price increase applies only to subscribers who join after it takes effect. If you cancel and later subscribe again, you subscribe at the rate in effect when you return.
  • TeamOS™ floor: anyone who pays $1,000 or more for a TeamOS™ tier and continues on Inner Circle afterward is locked at $97 per month permanently, regardless of subscriber count or when they join.
  • Included months (every TeamOS™ tier): four months included at no additional charge. Cancel any time before the four months end and you are never charged for the continuity. If you do not cancel, billing continues automatically at your locked rate. A TeamOS™ return or refund ends the continuity, as stated for each tier above.
  • Cancelling: you can cancel at any time. Your cancellation takes effect at the end of your current billing period: you are not charged again, and your subscription continues through the end of the period already paid for.

Structural Bearing™ Diagnostic ($3,000 minimum).

  • Cancellation and refund: you can cancel at any time before your Diagnostic call takes place, for a full refund. Once the call has taken place, the fee is not refundable. Missing a scheduled call without cancelling beforehand is treated the same as attending it: no refund.

Surveys and What You Tell Me.

  • Answers you give to an optional survey, and what you share in an application, are used to serve you and to improve my products. I may also use survey answers in aggregate, with no names and no identifying detail attached. I never publish an individual's answers or identify their employer without their permission.

Purchases

Everything sold on the Site is sold by me, through Management Coaching of Wyoming, LLC. No other merchant sells through the Site. You must be 18 or older to make a purchase. You agree to be financially responsible for every purchase made by you, or by someone acting on your behalf, through the Site, and to make purchases for legitimate purposes only, not speculative, false, or fraudulent ones.

Interactive Features

The Site may include features such as comments, community forums, and email, which allow feedback and interaction between users. You alone are responsible for material you post or send through these features. It is a condition of your use of the Site that you do not use these features to harass, impersonate, disrupt, gain unauthorized access, post unlawful or infringing content, transmit harmful software, or solicit commercially without my written approval.

I have no obligation to monitor content on the Site's interactive features, but I reserve the right to do so at my sole discretion, and to edit, refuse to post, or remove any content for any reason.

Registration and Passwords

To access certain features of the Site, I may ask for registration information. You agree to provide true, accurate, current, and complete information. To use certain features, you will need a username and password; you are responsible for keeping them confidential and for all activity under your account. Notify me immediately of any unauthorized use of your account.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER I NOR THE COMPANY IS LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OF, OR THE INABILITY TO USE, THE SITE OR ANY PRODUCT OR SERVICE OFFERED THROUGH IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. MY TOTAL LIABILITY FOR ANY CLAIM RELATED TO A PRODUCT OR SERVICE IS LIMITED TO THE AMOUNT YOU PAID FOR THAT PRODUCT OR SERVICE. IF YOU ARE DISSATISFIED WITH THE SITE OR ANY PRODUCT, SERVICE, OR MATERIAL ON THE SITE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO STOP USING IT, SUBJECT TO THE REFUND TERMS STATED FOR THAT PRODUCT ABOVE.

THE SITE IS CONTINUALLY UNDER DEVELOPMENT, AND I MAKE NO WARRANTY, IMPLIED OR EXPRESS, AS TO ITS ACCURACY, COMPLETENESS, OR APPROPRIATENESS FOR ANY PURPOSE.

Termination

I may end your access to the Site, or to any part of it, at my discretion. If I end your access to something you have paid for, I refund you. The restrictions on material downloaded from the Site, and the disclaimers and limitations of liability in these Terms of Service, survive any termination.

Payment Processing

Payments are processed by Stripe through my GoHighLevel checkout. I never see or store your full card number. You can read Stripe's privacy policy at stripe.com/privacy.

Other

If you believe in good faith that material on the Site infringes your copyright, you or your agent may send me a notice requesting its removal, by email to the address under Contact.

These Terms of Service are binding upon and benefit the Company and its assigns, successors, heirs, and legal representatives. Neither these Terms of Service nor any rights under them may be assigned without the Company's prior written consent, except that the Company may freely assign them to any affiliated entity or wholly owned subsidiary.

Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of Wyoming, and any dispute is subject to binding arbitration in Sheridan, Wyoming. If any provision of these Terms of Service is unlawful, void, or for any reason unenforceable, that provision is severable and does not affect the validity or enforceability of the remaining provisions.

Class Action Waiver. You may only resolve disputes with me on an individual basis, and may not bring a claim as a plaintiff or class member in a class, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any class or representative proceeding, unless all relevant parties specifically agree to do so after the arbitration begins.

Severability. If any clause within this Dispute Resolution section, other than the Class Action Waiver, is found illegal or unenforceable, that clause is severed and the remainder of this Dispute Resolution section remains in full force and effect. If the Class Action Waiver itself is found illegal or unenforceable, this entire Dispute Resolution section is unenforceable and the dispute is decided by a court.
